By accessing or using the FANN platform, you agree to these Terms of Service, our Privacy Policy, and applicable platform policies. These terms form a legally binding agreement between you and FANN Art Technologies Ltd.

We may update these Terms from time to time. Material changes are communicated in advance. Continued use after updates means you accept the revised Terms.

The following terms are used throughout these Terms with specific meanings:

You must be at least 18 years old and legally capable of entering binding agreements. Account information must be accurate and kept up to date.

You are responsible for account security and all actions performed through your account credentials.

FANN provides marketplace, certification, fractional ownership, community, rewards, and developer/API capabilities.

KYC verification is required for financial transactions to comply with AML and regulatory obligations.

Accounts may be restricted if verification is incomplete or cannot be validated.

Sellers warrant legal ownership, authenticity of listing details, and compliance with applicable laws.

FANN may review, reject, or remove listings that violate policy or legal requirements.

Payments are held in escrow and released after delivery confirmation or according to dispute-resolution rules.

Applicable buyer/seller platform fees are disclosed at checkout and settlement.

Fractional Tokens represent economic interests in a physical artwork held in custody.

Investments may carry valuation, liquidity, operational, and regulatory risks.

FANN coordinates specialist shipping partners. Risk transfers upon confirmed delivery unless otherwise required by law.

Claims for damage/non-conformity should be raised promptly with supporting evidence.

FANN platform assets (software, brand, certificates, systems) are protected by intellectual property laws.

Artists retain copyright. Sellers grant FANN a limited license to display and market listed works.

Users must act lawfully and respectfully on the platform.

API access is subject to rate limits, usage policy, and key security requirements.

FANN may suspend or revoke API access for abuse, data scraping, or policy violations.

Use of the platform is governed by the Privacy Policy, including data collection and processing practices.

Where applicable, data rights are handled under relevant legal frameworks and regulations.

The platform is provided on an 'as is' and 'as available' basis, without warranties to the fullest extent permitted by law.

FANN does not guarantee uninterrupted service, complete accuracy, or error-free operation.

To the maximum extent permitted by law, FANN's liability is limited as set out in these Terms.

FANN is not liable for indirect or consequential losses where such exclusions are legally permitted.

You agree to indemnify FANN against claims or losses arising from your misuse of the platform or violation of these Terms.

These Terms are governed by applicable law as stated by FANN. Parties should first attempt informal resolution before formal proceedings.

If any term is found unenforceable, remaining provisions remain in full force. These Terms and related policies form the full agreement.
